Terms Of Service and User Agreement

1. Acceptance of Terms

These Terms constitute a binding agreement between you and ECS. We may update these Terms from time to time and will notify users of material changes by updating the "Last Updated" date or posting a notice. Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.

2. Our Services

ECS offers remote sales training, career support, job board access, and other professional development tools for individuals interested in building remote careers as independent contractors. We do not guarantee employment or provide any form of recruitment or mediation services.

a. No Income Guarantee

We aim to deliver high-quality training and support, but we do not guarantee specific results, job placements, employment or income outcomes. Our Action-Based Guarantee is a service based guarantee only. Success as an independent contractor depends on personal effort, participation, and external market factors.

b. Temporary Interruptions

We may occasionally need to suspend Site access for maintenance, updates, or unforeseen issues. ECS is not liable for downtime due to third-party services or providers.

3. User Accounts

To access certain features or services, you may be required to create an account. You agree to provide accurate, complete information, and to keep your login credentials confidential. You are responsible for all activity under your account.

ECS reserves the right to suspend or terminate any account that violates these Terms, is inactive, or is being used in a manner inconsistent with the intended purposes of the platform.

4. Code of Conduct

Users are expected to engage with our platform, staff, and community with professionalism and respect. The following are strictly prohibited:

• Harassment, bullying, or threatening behaviour
• Posting or sharing inappropriate, defamatory, or illegal content
• Attempting to access restricted areas of the platform or others' accounts
• Misrepresenting your identity or qualifications
• Sharing proprietary ECS materials outside the platform without permission

We reserve the right to moderate, remove, or restrict content, services or users that violate these standards.

5. Intellectual Property

All content, branding, video materials, training resources, and technology used by ECS are protected by copyright, trademark, and other intellectual property laws. You may not reuse, distribute, or reproduce ECS content without prior written consent.

You retain ownership of any data or customisation you submit or build, but grant ECS permission to use it as necessary to deliver Services.

6. User Submissions & Ideas

If you voluntarily submit ideas or feedback to ECS (e.g. for new features or programs), you agree that ECS may use, modify, and integrate them into future products or services without compensation or obligation.

7. Call Recording & Data Storage

We may record calls, webinars, or training sessions for internal quality assurance, coaching, program delivery and marketing purposes. You will not be notified in advance of any recording taking place at the point of joining a call, webinar, or session. However, by agreeing to these terms, you acknowledge and accept that calls, webinars, or sessions may be recorded.

By participating, you consent to being recorded. These recordings are stored securely and handled in accordance with our Privacy Policy.

8. Disclaimers & Limitation of Liability

To the fullest extent permitted by law, ECS provides all services "as is" and makes no warranties, express or implied, regarding the platform, its content, or outcomes of use.

ECS is not liable for any indirect, incidental, special, or consequential damages, including loss of income or business opportunities, arising from the use of or inability to use our services.

9. Indemnification

You agree to indemnify and hold harmless ECS and its team members, affiliates, contractors, and partners from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms.

10. Third-Party Links & Services

Our Site may contain links to third-party websites or services. ECS does not endorse or assume responsibility for the accuracy, safety, or content of any external sites. Use of third-party services is at your own risk.

11. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus.

12. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
